Yes, this is a trick question. Often, clients will ask me about my win percentage, and I have to say, I don't even know how I would begin to answer that! A typical divorce or separation client will have several goals which may include the access schedule that he or she wants with the kids, a certain dollar amount of marital property or alimony, or maybe even keeping certain property from being considered marital. What if you get your ideal access schedule with the children, but a low amount for alimony? When I work with a client, I try to give the person an reasonable estimate of what the court might do. It is impossible to know exactly what the outcome will be, but I advise my clients that an settlement within the "realm of likely possibilities" is usually a good settlement. Many people would prefer a certainty that they had some control over, rather than a stranger in a robe make a decision about their beloved family. Smart clients will NOT assume the judge sees the situation exactly as they do!
